Abridged Terms and Conditions for Corporate Programmes

Please contact us if you want a full set of Terms and Conditions.

Corporate Programmes shall be defined as training courses and training programmes delivered (face to face or virtually) by Crescente Ltd directly to a Customer. This includes but is not limited to the following training courses: Management and Leadership, Diversity and Inclusion, Coaching and Mentoring, Sustainability Leadership, Mental Health and Wellbeing, and Primary Care. Refer to the Crescente Ltd website for details of courses.

By using our services you agree to our terms and conditions.

Payment

For standalone courses we will invoice you for the course on completion of delivery. For programmes we will agree payment terms with you during the design phase and prior to commencement of delivery. Payment for your course will be taken through Stripe or BACs and payment will be received by us upon confirmation from our provider that the transaction has been completed.

Where applicable, access to course materials (other than samples) will not be granted until the payment has been processed in full. Every effort is made to ensure this is no more than two working days.

If you have not been given access to course material within three working days, please contact us on admin@crescente.co.uk.

Cancellations

The Customer may cancel training by giving the required Days’ Notice in accordance with the cancellation table shown below:

Cancellation table:

28 days’ notice and over No delivery fee due
14 days’ notice and over 25% delivery fee due
7 days’ notice and over 50% delivery fee due
Up to 7 days’ notice 100% delivery fee due

 

Rescheduling of courses (discretionary, upon request) will be limited to one occurrence free of charge, however if a limited number or no learners at all attend an organised training session, this will count as a valid session and will not be subject to rebooking or refund. However, Crescente Ltd will make all reasonable efforts to assist in cases where mitigating circumstances are present.

Where applicable, in accordance with the provisions of the Consumer Protection (Distance Selling) Regulations 2000 you have the right to cancel your contract within a period of 14 days (the cancellation period) from the day of purchase.

Exceptions to this are when the pre-course or course materials has been accessed or downloaded. This right of cancellation shall not affect your statutory rights.

Should you wish to exercise this right of cancellation please send confirmation to the contact details provided as part of the booking process.

The course will be deemed to have been “accessed” when the relevant online course is commenced, or any associated materials are loaded or viewed by someone utilising your account.

Payments made via Stripe will incur a 5% fee when being refunded.

Non-completion/Non-attendance of Training

If you do not complete a course but our records indicate materials have been accessed or downloaded, the full fee remains payable.

If you do not access the course during the stated enrolment period, we reserve the right to cancel the order and withdraw your access to such services. You will not receive a refund if the order is cancelled as described in this paragraph.

If you do not attend any training session, whether face to face or virtual, the full fee remains payable.

However, if any of the above issues arise, please feel free to contact Crescente Ltd to discuss your individual situation. We will do our best to assist whenever possible.

Course Materials

Copyright and all other Intellectual Property Rights for all Course Materials and Crescente Ltd Website Content shall remain the property of Crescente Ltd.

You agree not to reproduce, republish, sell, hire or copy Course Materials or Website Content (in whole or in part) and not to use such materials except for the purposes of post-course reference, without first obtaining written permission from Crescent Ltd.

You agree not to record (audio or video) a course or any part of a course using any recording device without first obtaining written permission from Crescent Ltd.

Any unauthorised reproduction, republishing, selling, hiring, copying or storing of Crescente Ltd Course Materials and Website Content may be in breach of Crescente Ltd’s statutory or common law rights, which will result in legal action.

Confidentiality

Crescente Ltd and the Customer may be given access to confidential information from each other in order to perform their obligations.

Crescente Ltd and the Customer agree to hold the each other’s confidential information in confidence and not make the other’s confidential information available to any third party, or use the other’s confidential information for any purpose other than the implementation of the training.

Reselling or Redistributing Our Course Files

You may only resell or redistribute our courses with an explicit contract in place with Crescente Ltd. Purchasing a course or programme from Crescente Ltd, whether it be outright or as part of a licence, does not give you permission to sell on or provide our courses to any third party. Licences and course files can only be used by the person or company purchasing it.

Minimum System Requirements

Crescente Ltd is not liable for failure to heed the minimum system requirements resulting in difficulties accessing the course.

Login Details

Some courses provided by Crescente Ltd require secure access to the Crescente Ltd Learning Management Systems (LMS). If this is the case with you will be provided with login details. You are responsible for maintaining the confidentiality of your login details. You must keep your login details secret and take all reasonable precautions to prevent unauthorised or fraudulent use of them.

You must not disclose your login details to any other person or record your login details in any way that may result in them becoming known to another person. You agree to accept responsibility for all activities that occur under your account.

You should inform us immediately if you have any reason to believe that your login details have become known to anyone else, or if the login details are being, or are likely to be, used in an unauthorised manner.

Access and Course Expiry

For certain courses, access and expiry dates apply, if appropriate, you will receive full instructions on how to access your training and be notified of your expected start and completion dates. Access duration varies depending on the course you have purchased. You can ask us at any time for your remaining access duration by emailing your request to admin@crescente.co.uk.

Unforeseen circumstances

Courses are subject to cancellation or rescheduling at Crescente Ltd’s discretion. Crescente Ltd reserves the right to alter or amend course materials at any time.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under an order that is caused by an event beyond our control.

Events beyond our control are any act or event beyond our reasonable control, including but not limited to; server failures, software failures, industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, natural disaster, or failure of public or private telecommunications networks.

We try to ensure that our website is always available for you. In the event that our website is unavailable at any time and for any period (for whatever reason) we shall not be liable even if this means you cannot access your course during that period.

For CMI qualifications, we try to ensure their ManagementDirect site is always available for you. In the event the ManagementDirect site is unavailable at any time and for any period (for whatever reason) we shall not be liable even if this means you cannot access your course during that period.

Changes to these Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, we advise you to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.

Online and Distance Learning Courses and Qualifications

Online and Distance Learning Courses and Qualifications shall be defined as training (face to face or virtual) delivered by Crescente Ltd directly to a Customer. This includes but is not limited to the following training courses; Management and Leadership, Diversity and Inclusion, Coaching, Mentoring and Talent Innovation, Cyber Security, Sustainability Leadership, Mental Health and Wellbeing, Customer Experience, Healthcare. This also includes all Chartered Management Institute (CMI) associated courses provided through Crescente Ltd. Refer to the Crescente Ltd website for details of courses.

By using our services you agree to our terms and conditions.

Payment

Crescente Ltd only accept payment through Stripe or BACs. Payment will be deemed to have been received by us upon confirmation from our provider that the transaction has successfully processed.

Access to course material will not be granted until the payment has been processed in full. Every effort is made to ensure this is no more than two complete working days.

If you have not been given access to course material within three working days, please contact us on admin@crescente.co.uk.

Where an online course has been purchased which carries a prerequisite (such as the CMI top-up qualification), you should only purchase this course if you are already hold the relevant qualification. You will be contacted by the Crescente team for the relevant proof and will be provided with course access once your eligibility for the course has been verified.

In the event that you have purchased a course for which you are not eligible, no course access will be provided, and a refund of your payment will be made within seven days of the date this decision is communicated to you.

Note that payments made via Stripe will incur a 5% fee when being refunded.

Non-completion

If you choose not to proceed with your course but our records indicate that materials have been accessed or downloaded, then the full fee remains payable.

On reaching the expiration date of your course registration, Crescente Ltd reserve the right to withdraw your access to such services. No refund for non-completed course will be made.

Note that Crescente Ltd appreciate that life and work commitments can get in the way of training courses and are always open to discussing a learner’s individual situation if they are having difficulties. Please contact us on admin@crescente.co.uk in the first instance.

Cancellations

In accordance with the provisions of the Consumer Protection (Distance Selling) Regulations 2000 you have the right to cancel your contract within a period of 14 days (the cancellation period) from the day of purchase. Exceptions to this are when the course has been accessed, or the materials downloaded, or the induction and registration is completed for CMI qualifications. This right of cancellation shall not affect your statutory rights.

Should you wish to exercise this right of cancellation please send confirmation to the contact details provided as part of the booking process.

The course will be deemed to have been “accessed” when the relevant online course is commenced, or any associated materials are loaded or viewed by someone utilising your account.

For CMI qualifications, the course will be deemed to have been “accessed” when the induction session has been completed, the first assignment brief received and CMI registration processed by CMI.

Note that courses are subject to cancellation or rescheduling at Crescente Ltd’s discretion. Crescente Ltd reserves the right to alter or amend course materials at any time.

Training Materials and Website Content

Minimum System Requirements

Crescente Ltd is not liable for failure to heed the minimum system requirements resulting in difficulties accessing the course.

Access and Course Expiry

Your access begins from your confirmed payment date and will expire at the same time on your final day. Access duration varies depending on the course you have purchased. You can ask us at any time for your remaining access duration by emailing us at admin@crescente.co.uk.

During your course access, you will need to complete the training modules, complete the written assignments, submit any project work or course work to the required standard for certification (if applicable). All project work or course work or written must be submitted for approval at least 28 days prior to your expiry date.

The CMI allow the following durations for access to their systems and services and for full and successful completion of all assessments:

Award qualifications – one year from the date of CMI registration on that qualification.

Certificate and Diploma qualifications – three years from the date of CMI registration on that qualification.

Course Extensions

Each course is provided with a predefined access length; however you can extend the course on a monthly basis by purchasing an extension from within the course area.

Course Suspensions (course holidays)

We can offer a one-off course suspension of up to 4 weeks during your enrolment period, should you have work or personal commitments that will prevent you from studying. Please get in touch with us to request this. You must have at least 1 month of access remaining in order to request a suspension.

Support

During your course access you are provided with unlimited telephone and email support from one of our expert tutors. If you require additional support or have a problem with the support you are receiving, please ask to speak to the Programme Director for your course or qualification.
